New York State Attorney General Letitia James is calling on major credit card companies to immediately block transactions for illegal, flavored vapes. This aggressive move targets payment processors as a critical chokepoint to stop unregulated e-cigarettes from reaching underage youth across the state.

While New York is not attempting to ban all vaping products, authorities are strictly targeting those operating outside state and federal regulations. The state has witnessed a massive proliferation of retail vape shops, raising concerns about youth accessibility and addiction.
Currently, the FDA sets stringent regulations on what e-cigarette products can be legally sold. There are only 41 approved products on the market, limited exclusively to tobacco and menthol options. Consequently, virtually all fruity or sweet flavored vapes currently sold in stores are considered illegal.
Attorney General James emphasized that unauthorized sellers are exploiting mainstream payment systems to distribute these dangerous products. She formally requested that credit card companies step in as “blockers” to flag and stop these specific purchases.
“Right now, vape sellers are using mainstream payment systems to sell products that shouldn’t be on the market in the first place to kids,” the Attorney General stated. “If you are helping process the payment, then you are part of the pipeline. These companies have the power to shut this down, and they must act accordingly.”
This appeal to financial institutions is part of a broader, ongoing enforcement crackdown. Over the past 18 months, New York State authorities have successfully shut down nearly 600 illegal vaping storefronts in the New York City area alone.
