UK Bans Nicotine Pouch Sales to Under-18s as Legal Loophole Closes New rules under the Tobacco and Vapes Act 2026 ban the sale of tobacco-free oral nicotine pouches to minors.

The UK government will close a regulatory loophole on Thursday, October 29, banning the sale of nicotine pouches to anyone under 18. Implemented under the Tobacco and Vapes Act 2026, the restriction establishes a standardized legal purchasing age across all retail nicotine categories nationwide.

Cigarettes and e-cigarettes have faced statutory minimum age requirements for years, but nicotine pouches occupied an unintended gap in UK legislation. Because the products are tobacco-free, regulators could not classify them under standard tobacco controls. Additionally, because users do not inhale them, the products fell outside existing rules governing nicotine-inhaling products.

Dr. Marina Murphy, head of external affairs UK and scientific affairs at Haypp, pointed out that the loophole persisted due to this dual classification issue:

“This means that, despite containing nicotine, nicotine pouches could be legally sold to people under 18. This does not mean that underage sales were common, or that most retailers ignored age checks. Most retailers took a responsible approach and restricted sales to adults. But some unscrupulous traders did take advantage of this legal loophole.”

Distinguishing Nicotine Pouches from Traditional Snus

The surge in pouch sales has led to regulatory confusion with other smokeless categories, particularly Scandinavian snus. While both products are placed between the gum and the upper lip, their legal status and chemical profiles differ under UK law.

Product CategoryContains Tobacco Leaf?Inhaled?UK Legal Status (Post-Oct 29)
Combustible CigarettesYesYesLegal (Age 18+ only)
E-Cigarettes (Vapes)NoYesLegal (Age 18+ only)
Traditional SnusYesNoIllegal for sale in the UK
Nicotine PouchesNoNoLegal (Age 18+ only)

Traditional snus originated in Sweden and uses processed tobacco leaves; its commercial sale remains illegal across the UK. In contrast, modern nicotine pouches contain pharmaceutical-grade nicotine, plant fibers, cellulose, water, and food-grade flavorings, without any raw tobacco material.

Compliance Rules for Physical and Online Retailers

Closing the age gap sets an enforceable legal framework aimed at stopping youth access while keeping alternative products accessible to adult smokers seeking reduced-risk substitutes.

Starting October 29, retailers must incorporate nicotine pouches into standard “Challenge 25” protocols. Key compliance mandates include:

  • Universal ID Verification: Retailers must verify the age of any customer seeking to buy oral pouches, both at physical checkouts and via digital age gates online.
  • Ban on Proxy Purchasing: It is now an offense for an adult to buy nicotine pouches on behalf of anyone under the age of 18.
  • Equal Enforcement: Regulators gain the authority to fine non-compliant stores, ending the competitive advantage previously held by rogue vendors selling to underage buyers.

Consumers purchasing nicotine pouches should prepare for routine identity verification at all retail points of sale as the new provisions take effect.
