Effective April 30, Hong Kong enforces a strict two-tier penalty system banning alternative tobacco products in public spaces. Carrying over five vape pods or 100 heat sticks carries a maximum HK$50,000 fine and six months in jail, while smaller quantities incur a flat HK$3,000 penalty. Smuggling devices through customs risks a massive HK$2 million fine and seven years imprisonment.

Two-Tier Penalties and Tourist Warnings
The amended tobacco control law targets e-cigarettes, heated tobacco products (HTPs), and herbal cigarettes. Dr. Manny Lam Man-chung, head of the Tobacco and Alcohol Control Office, confirmed the ban currently focuses on public areas due to the logistical challenges of policing private residences. However, this is merely phase one of a planned territory-wide prohibition.
Foreign tourists receive zero leniency. Simply turning on a device in public triggers immediate administrative action. Travelers are strongly advised to inspect checked and carry-on luggage before flying, as customs officials will not accept “personal use” as a defense against smuggling charges.
